Digital Millennium Copyright Act Notice and Takedown Policy

Overview

BlogSphere respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), we have implemented procedures for receiving written notification of claimed copyright infringement and for processing such claims in accordance with the law.

Reporting Copyright Infringement

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible on BlogSphere, please notify us by providing the following information in writing:

Required Information for DMCA Notice

  1. Identification of the copyrighted work: A description of the copyrighted work that you claim has been infringed, or if multiple copyrighted works are covered by a single notification, a representative list of such works.
  2. Identification of the infringing material: A description of where the material that you claim is infringing is located on BlogSphere, including the URL or other specific location.
  3. Contact information: Your name, address, telephone number, and email address.
  4. Good faith statement: A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  5. Accuracy statement: A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  6. Signature: Your physical or electronic signature.

Important Notice

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages, including costs and attorney's fees.

Counter-Notification

If you believe that your content was removed or disabled by mistake or misidentification, you may file a counter-notification. To be effective, your counter-notification must be a written communication that includes the following:

Required Information for Counter-Notification

  1. Identification of the material: Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
  2. Good faith statement: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  3. Contact information: Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which the address is located, or if your address is outside of the United States, for any judicial district in which BlogSphere may be found.
  4. Service consent: A statement that you will accept service of process from the person who provided notification under subsection (c)(1)(C) or an agent of such person.
  5. Signature: Your physical or electronic signature.

Our Response Process

Upon receipt of a valid DMCA notice, we will:

  1. Promptly remove or disable access to the allegedly infringing material
  2. Notify the user who posted the material of the removal
  3. Provide the user with a copy of the DMCA notice
  4. Inform the user of their right to file a counter-notification

If we receive a valid counter-notification, we will:

  1. Forward the counter-notification to the original complainant
  2. Restore the material within 10-14 business days unless the original complainant files a court action
  3. Notify both parties of our actions

Repeat Infringers

BlogSphere has a policy of terminating, in appropriate circumstances, users who are repeat infringers. We may also, in our sole discretion, limit access to BlogSphere and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
